Prosecutors: Christopher Garza fatally shot Israel Pena in argument over burglary proceeds

Christopher Garza and Israel C. Pena were working together when they committed a residential burglary in Rockford, the prosecutors said Friday.

But when it came to distributing the proceeds of the crime, the pair’s teamwork spirit went south, authorities said.

Garza got so mad during the disagreement on the morning of Jan. 29, he grabbed a gun and fired at Pena several times while they rode in Pena’s sister’s car, Assistant Cook County State’s Attorney Todd Kleist said.

After shooting the 20-year-old Pena in the chest, arm and hip, Garza took Pena’s body out of the car and dumped it in the 1200 block of West 32nd in Bridgeport, Kleist said

The car the men had been traveling in was discovered burned a half a mile away that day. Pena’s body was found soon after.

Cell phone records indicate that Garza was near the murder scene and where the burned car was abandoned, Kleist said.

Garza also allegedly admitted to another person that he had killed Pena and set the car on the fire.

Two .45 caliber shell casings were found near the body of Pena, who lived in Rockford, prosecutors said.

While in custody at Area Central recently, Garza head-butted a Chicago Police detective as he was being transported from one room to another, Kleist told Judge Adam Bourgeois Jr.

Garza, 20, smirked in court while Kleist recounted the alleged attack against the officer.

The detective suffered swelling, bruising and redness to his eyebrow and right eye, Kleist said.

Garza, of the 4500 block of South Wood, has a pending residential burglary case in Bridgeview.

He was found delinquent for two burglary cases as a juvenile. He was also found delinquent as a juvenile for a weapons and drug case.

Garza was ordered held without bail Friday for murder and aggravated battery to a police officer.

A South Side man has been charged with the fatal shooting of Israel C. Pena of Rockford in the Bridgeport neighborhood in January.

Christopher Garza, 20, was identified as the man who shot Pena on Jan. 29, according to a statement from Chicago Police. Garza, of the 4500 block of South Wood, was arrested and charged with first-degree murder.

He was also charged with a felony count of aggravated battery to a police officer after police said he head-butted a detective while being questioned about an unrelated incident.

Officers found the 20-year-old Pena unresponsive on the ground with a gunshot wound to the chest in the 1200 block of West 32nd Street about 3:10 a.m. on Jan. 29, according to police and the Cook County medical examiner’s office.

Pena, who lived in the 800 block of Montague Street in Rockford, was dead at the scene, authorities said.

Garza was expected to appear in bond court Friday, police said.

Five men were shot to death and another was fatally stabbed last week in Chicago.

The most recent killing happened when 23-year-old Antonio Gamboa was stabbed at a Super Bowl party in the 2300 block of South Michigan Avenue when he tried to break up a fight between an arguing couple, authorities said.

Gamboa, of the 1600 block of North Kimball Avenue, died at Mercy Hospital and Medical Center, according to the Cook County medical examiner’s office.

On Saturday, 22-year-old Savoy Young was shot multiple times in an alley in the 8100 block of South Chappel Avenue in the South Chicago neighborhood about 11:15 a.m., authorities said.

Young, of the 8200 block of South Luella Avenue, died at the scene, according to the medical examiner's office.

On Friday, 34-year-old Leandrew Harper was shot multiple times in the 7000 block of South Honore Street in West Englewood about 5:40 p.m., authorities said.

Harper, who lived on the block, died at the scene, according to the medical examiner's office.

On Thursday, 20-year-old Israel Pena was shot in the chest in the 1200 block of West 32nd Street in Bridgeport about 3 a.m., authorities said.

Pena, of the 800 block of Montague Street in Rockford, died at the scene, according to the medical examiner's office.

In the West Pullman neighborhood, 24-year-old Myron Collier shot in the head near East 119th Street and South Yale Avenue about 2:05 a.m. Thursday, authorities said.

Collier, of the 10000 block of South Pulaski Road, died at the scene, according to the medical examiner’s office. A 29-year-old man was also wounded in the shooting, police said.

Christopher Cage, 27, of the 300 block of West 109th Place, was charged with first-degree murder in Collier's death, police said.

The killings started when 23-year-old Angelo Porter was shot in the head while walking in the 600 block of East 51st Street about 1:40 p.m. Tuesday, authorities said.

Porter, of an unidentified home address, later died at John H. Stroger Jr. Hospital of Cook County, according to the medical examiner’s office.

Additionally, 39-year-old Alexander Villafane, of the 2300 block of South St. Louis Avenue, died Tuesday after being wounded during a Jan. 25 drive-by shooting in the 3500 block of West 24th Street, authorities said.

Overall, the medical examiner’s office has ruled at least 29 Chicago deaths in 2015 a homicide.

Chicago Police, which counts murders different by following federal guidelines, reported 28 January murders, a 40 percent increase compared to January 2014, but a decrease compared to 2012 and 2013.

A Rockford man was shot to death early Thursday in the Bridgeport neighborhood.

Police found 20-year-old Israel C. Pena on the ground in the 1200 block of West 32nd Street about 3 a.m. Thursday, authorities said.

Pena, of the 800 block of Montague Street in Rockford, had been shot in the chest and died at the scene, authorities said.

Nobody has been charged for the murder.

Area Central detectives are investigating.
